How Bolivia Ended up With Elections by Presidential Decree

It appears that Bolivia's elections are well set for December 18th and the campaigns are in full swing here in Cochabamba. To explain, briefly, how Bolivia finally arrived at an election date set by presidential decree we have asked our Bolivian colleague, Boris Rios, to once again offer an analysis. His article was adapted to English by Democracy Center intern Gretchen Gordon.

How Bolivia Ended up With Elections by Presidential Decree
On November 1st, Bolivian President, Eduardo Rodríguez, issued a presidential decree dictating a new distribution of congressional seats and setting a new date of December 18th for national elections. Elections had previously been scheduled for December 4th, but, after being called into question by Bolivia's Constitutional Court and subsequent power struggles within the congress, it appeared for a time that the elections might not take place at all.
For six weeks, Bolivia's congress debated, without solution, the issue of how to redistribute congressional seats based on the most recent national census (in 2001), to assure equity based on regional population. The issue proved unresolveable, however, because the redistribution required that some departments (La Paz, Oruro and Potosí) lose seats, while others (Cochabamba and Santa Cruz) gain representation. Bolivia’s national electoral officials finally announced that the delay in Congress had made it impossible to hold elections on December 4th as scheduled.
Faced with a looming political crisis and national uncertainty, President Rodríguez took matters into his own hands to resolve the distribution question through presidential decree. The decree is essentially a compromise which redistributes four congressional seats: an addition of three for Santa Cruz and one for Cochabamba, and a decrease of two seats for La Paz and one for each of Oruro and Potosí. The decree then set the 18th of December as the new date for both national and local elections.
All of the presidential candidates declared their support for the decree, as did the majority of Bolivia’s congressional delegations, with the exception of Santa Cruz, which maintained its demand of no less than four additional seats.
Legally, the presidential decree must be approved by a majority of the congress in order to become law. Congress reacted by selecting to neither approve nor reject the decree, though the Santa Cruz delegation chose not to attend the session in which the decree was debated.
The current situation is that elections are moving forward for December 18th. However, absent the congress’ explicit approval of the decree, the door remains open for yet another legal challenge to planned elections.

I've been reading your posts and articles of recent and I want to let you know how much I appreciate them. I worked in Sucre for an NGO back in 2002 and I can't say enough of the experience. Now that I've found this site, you can bet I will be more involved.

Once again, the democracy Center tutored a pupil how not to tell the hole true, what a shame, but I guess that is the way politically motivate organizations work to lobby for support, I guess the democracy center is needing MAS support.
To put it strait, Boris son of Jim, Santa Cruz congressmen where not the only ones to oppose the decree; La Paz, Oruro and Potosi congressmen where not supporting it either, and a probe of that is that the Congress, which did no needed Santa Cruz congressmen votes to pass the a law approving the decree, did not do it.
You also failed to mention that Santa Cruz Civic Committee and their Congressmen worked hard to get all Bolivia’s department’s Civic representatives and Congressmen together in Santa Cruz to talk about the issue. You failed to mention that the Potosi representatives did not even accepted to participate and that La Paz representatives where the first ones to leave the meeting without reaching an agreement. You also failed to mention that President Rodriguez changes his posture of 2 additional congressmen to Santa Cruz to 3 additional congressmen to Santa Cruz and one to Cochabamba because of the meeting’s results and that is how he wrote the decree.
In short, trough the democracy center, you where trying to inform whoever reads this blog that the Santa Cruz people where the bad guys that did not wanted to let Bolivia continue its pat towards democracy, you guys are really something. Why you don’t inform that a Congressmen from La Paz and another from Cochabamba where the ones that sent the decree to the Constitutional Curt to try to legally block it.
Finally, the Santa Cruz congressmen did not participated in the congress session among many others, they where not the only ones not present in that session. But they did not participate because the Civic Committee asked them no to so because Santa Cruz deserved more that the 4 congressmen they asked for and 4 was the minimum acceptable, I let you tell us why did the other congressmen did not participate or approve the decree.
Nerveless, after the President’s decree, no one in Santa Cruz with any real political or civic power was menacing with violence, blockages or election boycott. With their actions they told the Country that they asked for a fare share of participation for their people and for Bolivia, they work to unite us, and they peacefully talked to everybody that wanted to peacefully find a solution to Bolivia. A final solution was not reached, but the meeting sent the President the new numbers that could save the Country. The Santa Cruz congressmen told us, hey, we did our part, if the rest of the Country accepts the President’s proposition, we will do nothing to prevent it from approval, tell me then Boris, why the decree did not passed?.

Well, as i can see, I am not the only one that realizes Boris did not provided all the facts AGAIN.
DOes not surprise me, his previous post on the "escanos" subject was also against Santa Cruz giving the opinion that the problem was caused by the rich elite camba created thanks to Banzer.
This time Boris does not give an opinion, he gives all facts...but you can also read "Paisano de Elite" facts...facts that you can find in Bolivian's news papers.

SO, why does Boris fail to tell us all these facts? ...maybe Jim will allow him to tell us.
Santa Cruz believes that by constitutional law, they should get 4 sits in congress...and i can accept the fact that they will not vote in favor of the decree that doesn't provide them with what they deserve, but they were clear that they will not fight to try to make this decree uncostitutional since they understand Bolivians want elections.
SO, Santa Cruz is not doing any action to get rid of the decree. How about Potosi Boris? Perhaps you heard they did some ROAD blockades around there (maybe they still do).
How about those 2 congress men (none from Santa Cruz)that put a claim to the "Tribunal Constitutional" to eliminate this decree. BTW, Tribunal did not accept one of them...but if they accept the other one....maybe we won't have elections in December...I know Boris, you still think the cambas are to blame.
Have a cunape and spend more time telling all facts next time Boris.
