Bechtel to Drop World Bank Trade Case Over Water Revolt

It is official. On Thursday, representatives of the Bechtel Corporation and its co-investor, Abengoa of Spain, will be in Santa Cruz to sign an agreement ending their four year effort to sue Bolivia over the Cochabamba water revolt. Bechtel and Abengoa have been seeking $50 million in damages and lost profits before a secretive trade court (International Center for the Settlement of Investment Disputes) operated by the World Bank, the same institution that coerced Bolivia to privatize its water to begin with.

Bechtel and Abengoa will sign an agreement dropping the case for a token payment of 2 bolivianos, about 30 cents. For a couple of weeks I have been communicating back and forth between Bechtel, the Bolivian government, and water activists here in Cochabamba, trying to force disclosure of the agreement details. As of last night, we have the last of those in hand.

This is a huge victory for activists worldwide who have fought this case on five continents. It is a huge precedent for the growing Web of legal cases in which the world’s most powerful corporations seek to tie the hands of people and governments to shape their own economic futures. We know of no other case in the world where a major corporation like Bechtel has dropped its action in response to global citizen pressure.

I read on Bolpress last week that in this agreement Bolivia pays 2 bolivianos for the water company but acquires several million dollars worth of its debt?? Hopefully not, this is otherwise great news.

The huge charade turned into an activist victory.

For all of you, reporters or not, just turning into Bolivia, here is a link to a report, FROM NINE DAYS AGO, of what the author of this blog is trying to sell as his premise.

Of course that the report in the link is a lot more detailed than this blog, although is not completely clear of what is really happening yet. What is unmistakable is that the self appointed water warrior of Cochabamba and Jim’s personal hero, Oscar Olivera, says that this deal is not convenient for us Bolivians because it is written en English, maybe he forgot his pal Jim could gladly spent some time to translate it for him.

Other thing that it is real; is that Bechtel and Abengoa will sign an agreement to droop the case for 2 bolivianos, or 30 US$ cents. You don’t really need to be a Bolivian to know that something smells fishy here, is like when somebody sells you a car for a price and offers you to sign the legal papers for a much lower price to avoid paying all the proper taxes.

In exchange for not being sued, the Bolivian government is buying 80% of Aguas del Tunari for a modest price of 8,2 million dollars. Do you all think Bechtel and Abengoa ever invested that much amount of money in Cochabamba, and we are not even talking about the 100% of the company.

So just to keep the Democracy Center and some fascist morons running the Coordinadora del Agua happy, Cochabambinos lost the great opportunity to have a state of the art water enterprise, look at what the World Bank did to help Saguapac in Santa Cruz; have a bunch of inept and corrupted people running the water supply in the city, will have no real inversion on water and sewage in many years, and will have to pay somehow; 8,2 million dollars from their pockets.

I can only guess that Jim believes this is a huge victory for the Cochabambinos because maybe his pall AGL told him that the money will be paid from the taxes of all Bolivians, and since only about of 35% of Bolivians pay taxes in the country and those people are the slime that did not voted for Evo, and since NGO’s money’s like the Democracy Center are not regulated, then we are just great; must be a huge victory in deed.

And finally, of course “there is no other case in the world where a major corporation like Bechtel has dropped its action in response to global citizen pressure.” The other Countries in the World are just so happy you decided to stick in Bolivia to help the Country go to hell along others WB haters that they are spending their time trying to convince the Bechtel’s and Abengoa’s to really invest in their country those 8,2 millions we are going to pay.

It's a good idea to read Bechtel's version of events, to notice what they don't say.

They don't mention the world bank's role in forcing privatization. Nor do they mention it's role in pushing the new national water legislation that regulated wells.

Is Jim trying to “sell” anything “as his premise”? Man, you are too perceptive, I didn´t notice.

The deal with Bechtel concerns a certain liability for the breach of an agreement; it does not refer necessarily to the actual investment in Cochabamba.

Have you ever read about any corporation loosing in the CIRDI against any poor country? They are so few, that I could bet you haven´t.

Please, try to put some order in your ideas, now you are saying that the "Coordinadora…” is fascist. Just a minute, are you the same Paisano who always fears a leftist plot in the universe? Now you think they are not leftists but fascists?

Sure, the World Bank has several good projects in Bolivia. Does it make the Bechtel´s a good one?

Bechtel was stupid enough to ignore the social background of this country. Awake! this is not Switzerland. Poverty changes everything, they didn´t notice, would you do? would Tuto do?

You have so many prejudices, that I can´t believe it. Do you say that all tax payers voted for Tuto and not for Evo? Where did you get that “35%”? I have worked for several years in Bolivian business and let me tell you that most Bolivian companies are involved in illegal accounting practices, so to avoid taxes… and most middle class professionals avoid taxes too through buying illegal invoices. Have you developed any method/ technique to identify these people? Well, you should go to the SIN (National Tax Service), they need you!

It´s true, we DO need foreign investments, but what we don´t need is the same stupid people negotiating those agreements on behalf of our country, pretending to be the chosen ones but always getting bad deals.

For those interested in the details, here is a brief discussion of the details on the debt issue raised by one of our readers above.

Following our Cochabamba news conference in December, warning that the World Bank trade panel had decided to take Bechtel’s case, the Bolivian government (publicly and privately) declared that a favorable settlement was imminent. They asked the Coordinadora and The Democracy Center to suspend our pressure campaign against Bechtel and we agreed to do so for a brief time, to allow the agreement to be concluded.

The promised date for the supposed agreement came and went, more than once, and the government never fulfilled its promise to make the draft agreement available to La Coordinadora or the Cochabamba public water company for review. Finally, just last week, an English version of the accord was given to us, which we reviewed carefully, both here in Bolivia and in the US.

One section of the agreement raised a good deal of concern. The agreement stipulates that Bechtel and Abengoa will sell their combined 80% share in Aguas del Tunari (AdT, the company they founded and which is suing Bolivia) for a token payment of 1 boliviano each. The agreement also stipulates that the two holding companies that Bolivia is buying have no hidden debts – with the exception of those disclosed in an annex. That annex showed that the two holding companies involved owed about $8 million to AdT.

Our concern was that, to have loaned the holding companies that amount, where did AdT get the money. Did it have some bank loan or other debt we didn’t know about? For a week we demanded clarification from the Vice Minister who, it was apparent from our meeting with him, didn’t really understand the details.

With a final agreement just days away and no satisfactory explanation forthcoming we did two things. First, Oscar Olivera made those concerns public, which was front-page news here. Second, I made contact with Bechtel and suggested they help clarify the matter themselves, to prevent the agreement from blowing up. Those two actions finally forced the response we had been waiting for.

Last night I received a detailed clarification from Bechtel and we met with the chief Bolivian negotiator. Their explanation was this. When Bechtel and its co-investors took over the Cochabamba water system in 2000 they deposited $10 million in Cochabamba as start-up funds. Later (I suspect after things got rough here) they moved $9 million back out of Bolivia in the form of a loan by AdT to the investors. That money never returned to Bolivia and the loan is still on the books, though canceled as part of the agreement.

In other words, there is no hidden debt involved. The agreement is a clean two-boliviano deal. It is also worth noting that this is the first time, to my knowledge, that Bechtel and its co-investors have admitted that they actually invested less than $1 million in Cochabamba. That makes their demand for $50 million even more outrageous.

To the reader who leveled the charges above, I have this advice. I realize that getting the actual facts may be a lot more work that casting accusatory rants based on misinformation, but you might find once in a while that it is worth the effort.

Well, as far as I can tell, paisano, quotes a Bolivian newspaper in where Oliveira does not seem happy about the whole thing.

In the other hand, we have the information that you provide, which apparently is not yet public (official); but that will have Oliveira happy and looking for another issue to raise up.

We all want the best for Cochabambinos; we don't want to pay with our taxes the abuses polititians provide us; that I see paisano and Jim have in common.

All the above responses that tend to crash against paisano with OUT arguments, logic, or examples to debate the matter analitically; those are the real misinformed.

Whom does not have information in their head, cannot debate.

And then ofcourse, you have the spinners like Pablito:

Yeap, in Bolivia, if you pay taxes you are out of businees. The competition will devour all of those companies that are formally tax payers. Thus, most of Bolivians, one way or the other had avoided paying taxes.

So, what Pablito does not say, is who pays less taxes. He is such the business man with broad perspective of Bolivian matters, that he does not know how much taxes the owners of buses, chicherias, comercio informal, etc, etc, etc PAY. Not to mention the smugglers that sell the goods "legally" from post that give a couple of nickels to the gobernment (right of sitting).

I don’t remember using the term leftist anywhere, I certainly did not use it in my post; if you are trying to mean communist, no I am not worry about it either. My preoccupation is socialism moving towards fascisms instead of social democracy in Bolivia. Today’s social movements are mostly fascist; this is the reality inside MAS, the Coordinadora del Agua, COB and several of the groups that compose the newly elected government. My biggest preoccupation is that there is a possibility of adding racism or prejudice to that fascism, and then you have the same thing that happened to the NAZIS in the Germany of the forties when most of them started as national socialists. I know that the possibilities are small, and obviously I hope it never happens, but MAS political campaign didn’t give me much to hope for about it, let’s see if we have autonomies before constituent.

I also recommend to you to read the words, “guess”, “maybe” and “about” from the post you are going to debate; people use those words when they are not certain of something; for you it will be much better if you start quoting people, since I never said, ”Do you say that all tax payers voted for Tuto and not for Evo?” , quoting you.

Why should we? Bolivians have explicitly asked for a Constituent Assembly for over 5 years. The aymara, quechua and guarani have petitioned and protested for greater independence and self-rule from centralist government since Independence.

It only makes sense to discuss autonomy, as well as land reform, resource allocation, electoral system, etc. in a Constitutional Assembly duly elected to do so.

In the meantime, the Santa Cruz elite should shut up, and hopefully will be able to sell more soy to Venezuela thanks to Evo's diplomacy.

Last time I checked, Chavez was ordering cuts in the imported amounts of Bolivian soybean and derivatives as well as other products (i.e vegetable oil) -few weeks after the "I want to bathe in a Bolivian beach episode"-.

Back then Evito probably wisphered to him that as you say "the Santa Cruz elite" (that's and F* ridiculous simplification my friend) were the only ones benefiting from trade.

It'll play well into Evito's "diplomacy" when the levels are "raised" to prior quantities; and say that it was an increment. Folks like you will buy the trick, others won't bite it.

What I heard, was that Chavez offered Bolivia $30 million dollars, and diesel in exchange for argicultural products. So, he waited a little and in the meantime got cheaper soy from U.S. I'm glad he didn't give support to the dying (dead, as of Sunday) neoliberal regime.

I do feel for those who make a livelihood from Santa Cruz's industry, and those who want simply to improve economic conditions. But make no mistake, the autonomy "movement" is nothing but a front for the interests of a tiny elite based in Santa Cruz that doesn't want to lose its ridiculous land holdings or social status.

Is it anyone who can afford their own car? It reminds me of a wooden practice dummy used for target practice. It appears to be anyone that actually made an income under the "Neloliberal" regime. I will explain it to you all again, not that I believe you will understand this time. “Elite” means “selected minority”, and is widely used in terms of intellect, politics, sports, society, military, business, etc, etc. If you only have the capacity of associating it with money, land ownership or political power, is your flaw to deal with it, not mine.

Culito blanco and villain themselves are and elite, the racist, prejudice elite walking the streets of Bolivia with blood in their eyes searching for somebody to blame their lack of success in life.

I don’t know if the elite you have in mind think to shut up, but I will certainly not; I will oppose anything in Bolivia trying to diminish our human rights, freedoms and the possibility of having a better future as a whole, remember, 47% percent of a country is a lot of people that also have all the right to have their way of thinking listened.

If history proves me wrong, I will also be the first one to recognize it, in my case, happily. I am still waiting for Jim’s explanation about the few US$ millions we are not going to pay with the water issue in Cbba. Heck, I while be the first to congratulate Jimy Boy and propose that whoever negotiate the water deal o negotiate the gas deal if things are going to finish as marvelous as he said. We will see tomorrow, don’t we ……

Regarding why autonomy, and I am really referring to the referendum, because, Culito, the valiant people of Santa Cruz worked hard without killing anyone, road blocking anyone, not throwing dynamite or rocks to anyone; in short, peacefully, to obtain enough signatures to immediately have a referendum for autonomies. If Bolivia doesn’t have autonomies before the Constituent, there is a grave risk that after it the country continues centralized, a fascist having to start doing business, see Venezuela my friends. Never the less, let’s check on Jim’s great news tomorrow.

Dear Paisano, I think you need to check your concepts. You are defining “fascism” as the opposite of “democracy”, and it´s wrong. I think you mean “dictatorship”, “authoritarian”, or something else. Besides, you put “socialism” and “left” in different categories. All this is getting confuse.

You got the wrong concept of “socialism” if you believe “national socialism” corresponds to what is understood today as “socialism” everywhere.

Anyway, you say that social movements are mostly fascists. That word has been an all-purpose political insult during the last 70 years. Would you give us your definition? I think that your´re trying to say that those movements are not democratic. I don´t remember any political party in Bolivian history being democratic, including Podemos. Does it make them fascists? Are you saying Evo/Olivares, etc are authoritarian? Man you voted Tuto but you didn´t know him.

We are building democracy Paisano, though things are still difficult we are more democratic than ever, and your ideas of “fascism” are simply missing the point.

You know, for you, culito, all the other bolivian readers of this blog, including me, it is easy to be part of the elite in a country like ours. Yes, if you have a computer you are already in, don´t even to mention speaking in other languages, holding an academic degree, etc.

But you need to say much more than that in order to deny a historical fact: the existence of a small number of people dominating this country economically, politically and in any other imaginable way during the last two centuries. Nobody can deny that this group of people have been ferociously and stupidly racists.

In deed, it is good for you to stand and fight for your human rights, but please don´t get offended if the people who have always been discriminated in this country try to do the same. Don´t call them fascists, don´t call them racists.

Something else, check the news today. It seems that Santa Cruz people also block roads, as desperate people use to do whenever and wherever there is no other way to be heard.

Have a nice weekend and try to think a little bit different than the rest of the “elite”

jonathan, there should be a ministry or institution to regulate air quality. too bad you don't see how progressive this move is, and make bathroom jokes about it.

by the way, paisano, one thing is "the elite" in the context of Bolivian geopolitical and economic power. another thing is the word "elite" which obviously has different meanings.

I did not say anywhere that Olivera would benefit from any deal with Bechtel -that's your invention, I'm suggesting that he may benefit from a pega in Evo's governement.

With respect to the "Water Ministry", I don't see it as progressive,... It's one thing to create a layer of bureocracy and government jobs for your pals an a completely different different thing to advocate efficient and sustainable use of water resources (which I do see as progressive)

And in case you are not aware of this, there is already a ministry devoted to sustainable development, and through its many agencies takes care of all things environment. And there is another set of institutions dedicated to regulating water usage in urban centers.

Pd: It's also progressive to stand by your beliefs and disclose your identity, or are you afraid you'll be branded an "elitist" because of your last name?

Anyway, I don't think my identity is important to any discussion of ideas and facts.

I share your concerns about bureaucracy but why don't we wait and see what becomes of the Water Ministry. I think the events of the past few years and the work of the Democracy Center specifically show that the previous regulation system failed to protect the water rights and water needs of Bolivia.

Beyond the symbolism, I think the re-merging of Sustainable Dev. and Economic Dev. is crucial. We need economic development that is sustainable socially and environmentally, there should be no distinction between the three.

For the record, late though it may be, SOCIALISM is a political theory advocating collective or governmental ownership and administration of the means of production and distribution of goods (see NATIONALIZATION). FASCISM adds the elements of a dictatorial leader and extreme nationalism and/or racism (see social movements in Cuba, Iran, Vietnam, etc.). The MAS campaign used both nationalism and racism as rallying calls (unless hating white people doesn't count). But where’s the dictator? Evo was freely elected (after completely undermining the constitutional process for three years). MAS holds the Presidency, VP, and leadership in the Senate and Diputados. They are going to re-write the constitution. They claim to want to make the constitution "more equitable" to the indigenous. No one can tell me where the current constitution is not equitable. Folks, ALERT, ALERT.

Question: Will one of the constitutional changes allow Mr. Morales to sit a second term?
