Vote Issue Explodes Again in the Constituent Assembly

The majority vote vs. two-thirds vote debate in the national Constituent Assembly has exploded again. This is the same issue that led to a day of work and road shutdowns in four Bolivian departments a few months ago. Leaders of the Santa Cruz civic committee say they are already examining options for “resistance”. All this comes just three weeks before a dozen Latin American heads of state are expected for a summit here in Cochabamba starting December 8th.

The vote dispute has raged for months in the Assembly charged with drafting a rewrite of the country’s constitution. MAS, the political party of President Evo Morales, has a comfortable majority in the body elected last July, but not a 2/3 majority. Not coincidently, while MAS readily agrees that the final product of the Assembly should require 2/3 vote for approval, it believes that the votes on the various pieces along the way ought to be passable by a simple majority.

Opposition parties, led by Tuto Quiroga’s PODEMOS, are demanding a 2/3 vote for every piece of the new proposal as it is constructed. Also not coincidently, that would give the opposition an effective veto over MAS and its solid majority. It also avoids a political scenario they clearly don’t want – facing a fully drafted new Constitution months down the road full of things they don’t like. It would be much easier for the opposition to block its development piece by piece along the way than to try to stop the freight train of political momentum it might have behind it at the end of the process.

Negotiations have been ongoing to develop a compromise alternative, centered around proposals by the small third force in the Assembly, Samuel Doria Medina’s UN party, that the more controversial elements under debate require a 2/3 vote and the rest require a majority. UN party members, including Medina, the wealthy owner of Bolivia’s Burger King franchises, have been staging a hunger strike to draw public attention to their demands.

On Friday the Assembly approved, by a lopsided vote of 140 to 87, a resolution calling for a majority vote on everything. MAS critics charge that the vote – in which MAS members voted as a solid block – was orchestrated directly by President Morales and have declared that it is a sign of his intentions for authoritarian rule. MAS officials have criticized the opposition of being anti-democratic by trying to use a minority block to hold up the substantive work of the popularly elected Assembly.

What is democratic here and what isn’t? The debate reminds me of the old saying, “In politics, where you stand depends on where you sit.” I have little doubt that if PODEMOS and the UN were in the MAS position of a solid majority, but shy of 2/3, they would be solidly in favor of a simple majority vote. I also have little doubt that if MAS were in the opposition it would be screaming for a 2/3 vote.

The debate in governmental institutions over when “super majorities” should be required is not unique to Bolivia. In the California Legislature where I worked for years, there has been a debate for decades over whether the state budget should require 2/3 approval, as it does under the constitution, or whether it would be more “democratic” to let it be approved by a simple majority. The fact that Democrats favor a majority and Republicans 2/3 is strictly about who is in the majority (Democrats). The Republicans majorities in the US Congress have been famous the last two years about calling for an end to super majorities to cutoff filibusters and approve [Bush] judicial appointments.

To be sure, in Bolivia there is a reasonable debate to be had over principle on simple majority vs. 2/3 and I suspect that a handful of political scientists somewhere are eagerly engaged in that debate. But let’s not be foolish – the debate in Sucre is about power not principle and both sides are playing to work their advantage. That doesn’t mean that compromise isn’t a good thing on the issue – not so much for the sake of democratic principle but because Bolivia’s process of political transformation needs to keep moving forward without blowing up the country.

I'm one of the political scientists engaged in the debate. And I come down on the side of two-thirds for every piece of legislation. Is that a veto for the opposition? That's one way to look at it. But the opposition certainly can't pass anything w/o at least some compromise w/ MAS, either. So the dominant position will remain w/ MAS, regardless of the voting rule.

The difference, of course, is that a two-thirds majority will require MAS to cooperate w/ opponents (and not just Podemos, other upet include leftist groups like AS & ASP). This will make the new constitution a product of consensus.

The other dangerous bit, of course, is that if the new Constitution isn't approved by 2/3 in the assembly, it will go to direct popular vote in referendum. More than likely, the document will pass (more than likely, ANY document would pass -- who's going to vote against a new constitution? and who's going to actually sit down and read the 100+ page document?).

The danger is that we could have a new Constitution that is openly rejected by major political actors (parties, social movements, regional groups, etc). That's extremely dangerous in a democracy. If neoliberal can be toppled by popular uprisings, don't you think populists can, too? Or, worse, a military intervention?

The sad reality is that MAS seems more obsessed w/ power, than w/ consensus. The MAS reforms are radical, so they're being resisted -- the trick is whether MAS is willing to give up some of its reform program to get the rest, or whether it wants to engage in brinksmanship in hopes getting all or nothing. The most likely result is that they'll get nothing, and a nasty repressive regime to along w/ it. At least that's the historical precedent in Latin America (and particularly in Bolivia).

So, the Democracy Center point of view over this democracy issue is ……. ni chicha, ni limonada ………. neither wine nor grape juice……. Whatever happened to your slogan “helping people build democracy from the ground up”; what about some help explaining us why it is democratic when 39% of all Bolivians will not have the democratically right to have their points of view weighted at the time where the rules of their lives and their future generations lives will be defined.
According to your post numbers in the last resolution voting, the MAS party and their allies already have 61% of the constituent votes, they only need 5% more to get to 2/3; which it means they only need to compromise with 11 more people. Why is that they are not capable to do that, as fare as I can see, because they are not whiling to compromise.
You keep trying to misinform your readers implying that the only opposites of the MAS regime are the Santa Cruz Civic Committee and the PODEMOS political party. It is funny you do not mention the Cochabamba, La Paz, Tarija, Pando, Beni & Santa Cruz prefects, all democratically elected by majority of votes in these 6 out of 9 Bolivian States and that do not approve what the MAS regimen is doing. Further more, PODEMOS alone cannot stop or obstruct anything in the constitutional assembly; since they are not even close to have 1/3 of the representatives. The MAS regime doesn’t need even one PODEMOS vote to get to the 2/3.
As fare as it can be noted, your democratic interest are more a quest of your own personal power; since you write like you are hopping to be in the middle of a real war, where you will be the Gringo hero helping the long repressed local indians to fight for freedom and power. The thing is, there are not repressed local indians and they already have the power; having you demonstrate in the past that you are whiling to help other people to get blood in their hands to get what they want; just remember that when blood is spilled, you can easily get splashed.

I can understand passing laws with a simple majority. In the US this is done, but requires ratification by the President. When both the majority and the President are in the same party, they can move their agenda forward relatively easily. Still, the most drastic examples I've seen in recent history are gun-ban laws by the Democrats and Homeland Defense by the Republicans. Here we are talking about drastically changing the fundemental document of Bolivian law! It supposed to be difficult.

Unfortunately it seems to me that I am now on the sidelines watching Bolivia self-destruct. Morales and MAS give every indication of a future totalitarian regime. Unless something beyond my limited vision changes, MAS will railroad through a constitution leading to an incredible divide. Samuel Doria Medina is right; why even bother showing up at the assembly any more.
