The Legal Case Against Gonzalo Sánchez de Lozada Moves into High Gear
Can former heads of state be held legally accountable for human rights abuses they committed while in office?The issue of 'impunity' has hung over Latin America in particular for a long time. With the arrest of Chile's Augusto Pinochet at the bequest of Spanish prosecutors in 1998, a new legal era of accountability was born affecting former leaders who once assumed themselves immune from accountability. The past month has seen the move for accountability move into overdrive. Peru's ex-President, Alberto Fujimori, was extradited back to Peru from Chile, where he faces criminal prosecution for human rights abuses. Also in Chile, where General Pinochet himself escaped prosecution by dying, his widow and children were arrested last week on corruption charges.
This month Bolivia will commemorate the fourth anniversary of the public ouster of President Gonzalo Sánchez de Lozada. As it remembers the bloody days of October 2003, legal moves against its former-president and one of his top aides have also moved back into high gear and into the headlines both in Bolivia and the U.S.
Sánchez de Lozada fled Bolivia on October 17, 2003 following his government's bloody repression of protests against his plan to export the nation's natural gas at bargain prices to the U.S. through Chile. Sixty-seven people were killed and more than 400 wounded. Since then the former head of state has been living in self-imposed exile in suburban Maryland, resisting Bolivian court orders to return for testimony and trial, and protected by the Bush administration.
Two important legal developments suggest that Sánchez de Lozada's Chevy Chase retirement may not go as smoothly as he had hoped.
The Criminal Case
For four years the families of the victims of October 2003 have campaigned to extradite Sánchez de Lozada, along with two aides, through a criminal case in the Bolivian court system. In 2005 Bolivia's Congress, still controlled by the former president's own party, authorized the prosecution and shortly afterwards the Bolivian Supreme Court issued an order commanding Sánchez de Lozada to return to Bolivia to provide testimony in the case. Following international law, that order was formally transmitted to the U.S. government, which bore responsibility to serve the notification to its Maryland visitor. Two years later, the Bush Administration had still refused to serve those papers.
In August, Bolivia's Supreme Court issued a finding that Sánchez de Lozada didn't need to be served by the U.S. to be made aware of the prosecution – noting among other things his appearance on CNN proclaiming his refusal to return to Bolivia for trial. So, in September, the Court issued a formal request for extradition. A week ago in Washington Bolivia's ambassador told me that the Embassy is currently preparing the English translation and is meeting with the U.S. State Department to insist that the U.S. honor its international legal responsibilities and end its protection of the deposed president.
Few people, in either Bolivia or the U.S. believe that the Bush administration, or any subsequent to it, is likely to escort Mr. Sánchez de Lozada to the airport in Miami for boarding. The U.S. has a long history of providing safe haven to deposed leaders with human rights records far worse than the ex-Bolivian president's, including the Shah of Iran and Nicaraguan dictator Anastasio Somoza. But that doesn't relinquish the U.S. from its legal duties nor will it detract the move by the families to demand justice.
All of which makes a new civil case against Sánchez de Lozada all the more important.
The Civil Case
On September 24th the legal moves against Sánchez de Lozada took a new turn, one that may prove far more worrisome to the man in Chevy Chase and his former top aide. With the backing and pro bono firepower of the Center for Constitutional Rights and the International Human Rights Clinic at Harvard Law School, civil suits were filed on behalf of the families against both Sánchez de Lozada and his former top deputy, Carlos Sánchez Berzaín, who now lives in Florida. The case charges both men with extra-judicial killings in the Black October massacres.
The twin civil cases charge Sánchez de Lozada and Sánchez Berzaín with responsibility for ordering the use of deadly force by police and troops. This included the use of machine guns as well as government snipers against unarmed protesters and children. All ten plaintiffs in the cases are family members of those killed in the protests of October 2003. Eloy Rojas Mamani and Etelvina Ramos Mamani’s 8-year-old daughter was killed in her mother’s bedroom when a bullet came through the window. Teofilo Baltazar Cerro’s pregnant wife and unborn child were killed. Felicidad Rosa Huanca Quispe’s 69-year-old father was shot and killed along a roadside.
In the civil suit, the families are seeking both compensatory and punitive damages, potentially enough to bankrupt both men.
As foreign citizens in the United States, the charges against the two men are being brought under the Alien Tort Statute and the Torture Victim Protection Act. The Alien Tort Statute was implemented in 1789, originally intended to prosecute foreign pirates residing in the country. It has since been utilized in a number of cases, including a successful suit against former President Marcos of the Philippines won in 1995. Lasting nearly 10 years, this suit, which also brought charges of crimes against humanity, ended with $2 billion of damages being awarded to victims’ families.
Marcos, like Sánchez de Lozada, had been a staunch U.S. ally. In 1981, five years before he was also run from the country by his own people, then-Vice President George Bush praised Marcos’ “adherence to democratic principles and to democratic processes." Mr. Bush's son lavished similar support for the embattled Sánchez de Lozada in 2003.
"No Safe Haven"
In Bolivia and elsewhere, Mr. Sánchez de Lozada has many boosters, most of whom cite political reforms he carried out in his first term in office in the 1990s, rather than his bloody short-lived term that ended four years ago this month. Among most Bolivians however, his name has become synonymous with gross acts of corruption and the giveaway of all of the nation's major industries to foreign corporations. More important, for more than sixty Bolivian families, Mr. Sánchez de Lozada's name has become synonymous, along with that of Mr. Sánchez Berzaín, for the smug impunity that allowed them to order the killings of their families followed by happy and wealthy lives in Maryland and Miami under U.S. protection.
The civil case fills that gap in justice, creating the potential for both public shame and a massive financial hit against those the families believe are responsible for the killings of their loved ones. Both men can expect to devote a good deal or their time from this day forward to writing checks to expensive U.S. lawyers, to having to defend themselves publicly for the events they presided over and, potentially, to following in the footsteps of Mr. Marcos and seeing their personal fortunes evaporated. A case that seemed, just a month ago, to have fallen to the margins, is now a real threat.
Judith Chomsky, an attorney from the Center for Constitutional Rights declared, “Human rights violators such as the defendants can no longer assume that they will have a safe haven in the United States; instead, our courts will hold them accountable for violations of universally recognized human rights.”
"Sanchez de Lozada should pay for what happened in our country," Juan Patricio Quispe told the Washington Post. Mamani's brother was shot in the back by soldiers under the former President's command on Oct. 12, 2003. "We want justice."
This week, he and other families are a big step closer to actually seeing that justice come to pass.

Jim, this is great, if it goes as planned and Goni is brought to trial for mass murder, genocide and human rights abuse it will be an excellent precedent for us Bolivians to be able to get Evo Morales and a couple of his zealots on the guillotine for the same crimes of less humanity.
Let’s see, I have in account the following murders directly attributed to the mazist regime. Santiago Orocondo, 22 years old, member of “Los sin techo” (People without a roof) on Pampa Ajasi, Oruro. Assassinated by a bullet from a brutal governmental repression. 2 coca leaf peasants in the Cochabamba Tropic where brutally assassinated by Evo’s military forces, first there was an accusation, from the mazists, about narcotraphic; but at the end, the government finally say those coca leaf plantations were illegal. Of course, they were not affiliated at Evo’s coca grower unions in el Chapare, do you know anything about what the “Human Rights Clinic at Harvard Law School” think about a president using brutal force and deadly force to oppress the competition.
In Huanuni, Oruro we have 12 deaths, all attributed to Evo and the mazists in an intent for their political forces to gain terrain in the miner sector. VP Lineras was quoted saying the regime will send the boxes for the dead instead of the police force.
In Cochabamba, January 2007, we had bloody January under Evo and the mazista hands, 3 deaths, Christian Urresty, a teenager, was brutally beaten to death and hung from a tree in front of a church by Evo’s mazist zealots under the command of some of the regime’s senators and ministers, currently being prosecuted by human rights groups in Bolivia.
In Camiri last April 18, Hernan Ruiz, 37, father and husband, was murdered by a lost bullet fired by Evo’s army, the mazista want to clean their hands saying he was in a political motivated protest, like if their bloody Oktoberfest 2003 were not.
And fresh in the memory is Flores Torrico, the 21 year old student just murdered in Arani, Cochabamba a few days ago by governmental forces. He was just asking to the end of corruption and better conditions to rural teachers.
That, just out of my mind, are 20 murders by the Evo and his regime, I have no doubts that the assassinated will greatly increase by the time we get him on trial. By the way, do you happen to know if Venezuela, Cuba or Iran, where Evo and his zealots are most likely to seek refuge; have any laws that will permit us to sue them for human rights violations? I will really hate to know that a trial like that is only possible in countries like the US that have governments with such a poor performance in human rights. If not, any possibility to get Evo on trial if we move the UN to Havana, Cuba?
The criminal case not come to fruition because Goni will not face a fair trial in the US.
The civil case has better chances but will go to appeal and most likely to a Bush appointed conservative judge.
Either way, things sure to drag and Goni should enough money to build his own Harvard AND Yale team.
Odds are still 50-50 that he would ever face trial in Boivia. Considering the way Evo and the MAS are managing Bolivia, I would increase the odds of him returning vindicated and triumphal during the upcomming collapse in the commoditties market from 500-1 to 125 to 1.
Anyone who thinks Goni is guilty of "genocide" doesn't know what the word means (and trivializes the word). So long as that "charge" remains, Goni won't be extradited to Bolivia.
Goni made serious mistakes in 2003. But his behavior is not on the same scale as Fujimori or Pinochet. Again, to make that comparison trivializes the systematic repression of such regimes.
Similarly, though Goni made a number of mistakes, he did not specifically arm & organize private militias (like the Ponchos Rojos or, in the opposition side, Nación Camba). Again, these subtle differences need to be kept in clear sight. Otherwise, we risk making glib comparisons that end up damaging our political vocabulary, as well as limiting our ability to make lasting change for the better.
So has the price and availability of gas in El Alto improved in the slightest since October 2003?
Center for Constitutional Rights? William Kunstler's group? What on earth are you doing associating with a group like that, Jim? They're the ones that defended the terrorists that were responsible for the first World Trade Center attack in 1993, and have continuosly defended terrorists since then.

Why, in your opinion, should Jim be associating with an organization that defends terrorists?
And regarding the Gas War of 2003 - how did blocking the sale of gas to Chile result in either a decrease in price and an increase in the availability of gas in El Alto? That was the goal of the protests, wasn't it? Or did they really just want to "stick it" to Chile and the multinationals, just out of sheer spite, regardless of the consequences to the people of Bolivia?
Frank_ibc, In my country, the United States, we have a tradition of defending criminals as part of our judicial process. Certainly this tradition has not always been honored, but almost everyone here agrees with the principle. Sometimes organizations like the CCR step in and other times defendents must depend on sleepy attourneys.

Bolivia does not have that tradition. You must understand that in our culture, only a criminal defends a criminal.
This is why Evo has made it ilegal for anyone who ever worked in the capitalizacion process or being counsel to a multinational corporation from: ever working for the government; ever receving any social benefits (e.g. retirement) and any company who has any of them on their payroll cannot be contracted by the government.
But if Bolivia is already having trouble selling Brazil and Argentina all they want, and would be committed to selling gas to Chile also, wouldn't there be even less for El Alto?
It wouldn't be surprising if Bolivia someday sells gas to Chile, but passing up the opportunity does not seem as if it could be affecting supply in El Alto today.
I think one big reason for the problems with gas supply within Bolivia now is that the prices are subsidized. Subsidies lead to increased demand and decreased supply, according to mainstream economic theory (everything else being equal). More people want more gas and suppliers want to sell elsewhere.
It's difficult to balance and certainly difficult to raise the prices. When Carlos Mesa tried to raise domestic prices on diesel (and other hydrocarbons, right?), he got lots of pressure, including the cabildo in Santa Cruz in January 2005.
It might be a reasonable choice to give your people and businesses cheap gas, but it must be harder to manage and have costs in export earnings.

It doesn't seem that the lack of gas for El Alto is due to less gas in the ground. Rather, it seems to be chiefly due to: a) lack of experience by those now running the newly nationalized industry and b) massive corruption (i.e. selling contraband gas).
As for CCR. I agree that all criminal defendants deserve competent legal counsel. If Osama bin Laden is ever captured, the best "vengeance" we can ever inflict upon him is to prove him wrong by giving him competent counsel, a fair trial, and (assume he is sentenced), a comfortable cell w/ three square meals a day.
Saw Goni some weeks ago. Didn't look too worried.
Last time we checked, the US just doesn't like to extradite.

Regarding the genocide charges, I've long held the same misgiving as mccentellas about this case. But I looked into it further. Bolivian law clearly defines genocide for itself, and, while I forget the exact language it uses (does anyone here have it?), it explicitly includes a subcategory that is defined as a kind of massacre including 3 or more deaths. It is pretty clear that this is at least worthy of trial in the case of Goni.
As I understand things, the trouble will come in the extradition process, because I believe for an extradition to go forward, the extraditing country (U.S.) must have a similiar crime with a similar punishment on its own books (i.e. even if Bolivia signs an extradition treaty with Iran, it will not extradite Iranians for being gay or dressing immodestly). So, since the Bolivian legal definition of genocide is, as I understand it, fairly different from both the U.S. and international law definitions, I see this as a snag.
That said, such treaties also allow the extraditing country to dictate which of the charges can be tried following the extradition, i.e. the U.S. could still process this request and decide to send Goni to Bolivia to be tried for extrajudicial killings, etc., while prohibiting him from being tried for genocide.

Maybe Goni will get back in time to be tried under the new constitution. There must be a guarantee of a right to fair trial in all that verbage somewhere.
At the very worst, he was trying in an inept way, with poorly trained personnel, to defend some basic democratic principles. There was no genocide. That was propaganda put up by Evo and his cronies to disguise the role they played in sending unarmed innocents off to the slaughter.
Where was Evo when the events of October were playing out? Not on the front lines. But now his true colors are showing, as well as Garcia Linera and the rest of the lads and lassies.
A quick check would show that there have been a number of violent deaths at the hands of the police, always under-reported (the real death toll at Huanuni, for instance, was closer to 30), private property is being invaded by campesinos in every department of the country, illegal deforestation is being conducted by the military, environmental problems are mounting, jobs are being lost due to no new investment by local or foreign entities, corruption is rampant, the nationalization of the hydrocarbons industry has failed utterly and pathetically, children are being exported for labor and abuse in neighboring countries with the de facto blessing of the government, more land than ever before is being planted in coca, the Chapare, where a lot of the coca is grown, is off limits to the police and armed forces and has its own private police (while Evo remains the president of the coca growers union), a clandestine meeting in an army barracks to approve the new constitution.... Thank God democracy is alive and well here under Evo's watch.
