A New Constitution, and Fresh Battle Lines
Events in Bolivia, surrounding the adoption of a new Constitution, have begun to happen so fast and furious that we'd have to put up new posts every few hours just to keep up. In addition, the Constitution approved by the Constituent Assembly is 405 articles and 100 pages long. A real analysis is going to take a bit of time.So, for this post, we offer an overview – of what the various warring sides have to say about the Constitution approved over the weekend, and of the events across the nation in reaction to that approval. We'll get to a more complete analysis of the Constitution itself later.
THE NEW CONSTITUTION: WHAT THE VARIOUS SIDES HAVE TO SAY
Depending on which version of events you wish to believe, the adoption of a new Constitution over the weekend by the Constituent Assembly is either the fulfillment of decades of campaigning to right centuries of injustice, or a headlong step toward authoritarian rule by Evo Morales and MAS. As usual, the two sides farthest apart, MAS on one side and PODEMOS and Santa Cruz Civicos on the other, are prone to political exaggeration. Here's a look at what they have had to say.
The Word from MAS
We have had to deal with pressure, not just from the right, but from our families. After we were kicked out of Sucre and after they would not let us finish our work, we had to finish in Oruro. But our work has not finished; now we have to guarantee approval [of the new Constitution] in the referendum.

The rap from MAS and Morales: The new constitution is a historic step that, for the first time, recognizes Bolivia's 36 indigenous peoples, establishes public control of the nation's key natural resources, and establishes a critical set of individual and community rights. It also allows Bolivia to pave a way forward based on a variety of economic models, not just foreign corporate control. The Constitution was approved legally, and after more than a year of dialogue and work by people with many different views. The leading opposition party, PODEMOS, failed to participate in the meeting over the weekend by its own choice.
The Word from the Opposition
The Assembly has broken democracy and order in the country, becoming the imposition of the governing party and robbing Bolivia of the historic opportunity to have a new Constitution clearly inclusive. But Bolivia has been a sea where countless authoritarians have drowned and no action that has been imposed against the will of the people has lasted.

Rap from the opposition: The Constitution approved over the weekend is illegal because the Assembly failed to give opposition members the legally required notice for the session in Oruro. It's main objectives are to consolidate power into the hands of MAS and Morales, by allowing reelection of the President for an additional ten years, and by eliminating full representation by minority parties in the Congress and letting the majority party alone approve key government appointments. It also lets the government prosecute, as 'traitors any individual or group accused of advocating division of the nation.
The Word from the Middle of the Road
It's overall not a bad constitution, but the problem is the official party didn't listen to anybody else. It seems this matter of presidential re-election was Morales' final goal all along.

UN's chief criticisms: Presidential reelection in any form is a doorway to authoritarianism in Bolivia. The new Constitution undermines minority representation in the Congress. Many of the articles are vaguely worded or incomplete and need to be modified. MAS did not include many of the consensus points worked out in the multi-party discussions in October.
WHAT NEXT?
Again, the big question here is whether the heated differences between the various parties and regions will be worked out through a political process or in the street. Most likely, according to Bolivian custom, we can expect a good bit of both.
President Morales, while trumpeting the Constitution and defending its legitimacy, has asked again that the nine Governors meet with him and talk about a way forward. Five of those Governors, meeting in Cochabamba yesterday, showed no signs of being interested in such a dialog. Four of them – from the regions where regional autonomy was approved by voters last year, the Beni, Santa Cruz, Tarija and the Pando – announced that they would be declaring that autonomy from the national government effective this Saturday. What that means remains unclear.
We can certainly look forward to a flurry of elections in Bolivia in 2008. There will be one in which the new Constitution will be voted up or down by a majority vote. Another will take up the land reform issue, where the new proposed article received a majority vote but not 2/3. Then of course there will be the proposed 'recall' vote to give voters the option of abruptly ending the terms of the President, Vice President, and the nine state Governors. The formula for that vote will now become the next big political debate here.

A FEW ADDITIONAL OBSERVATIONS TO ADD TO THE MIX
First, I think that, in fact, the opposition from PODEMOS and the eastern departments got just what they wanted this weekend. If they had really wanted to kill the MAS Constitution in its Oruro cradle all they had to do was show up and vote 'no', article by article. The approval was based on a vote of 2/3 of those present. The opposition's absence, which was deliberate, assured that MAS could achieve that. Consider these two opposition choices. Choice one: Show up in Oruro, kill the MAS Magna Carta, article by article, and face the wrath of a really pissed off mass of indigenous groups, social movements and others. Choice two: Let MAS ram through its Constitution without opposition support or participation and have the rallying cry of 'beware the authoritarians' fall right into your lap. Which option would you pick if you were them?
Second, MAS is going to have a real hard time convincing swing voters that the approval process was 'kosher', to use a Bolivian term. Talk to people present and you will here the story of one article after another voted on by a quick show of hands with no real debate or reflection. As I have written before, I really don’t see how MAS and other backers of the new Constitution expect to win 51% for it given that MAS political ceiling seemed to be pretty pegged at 53% two elections in a row and given that in a yes/no vote on the Constitution much of the party's urban middle class political base will desert it and the opposition will be unified, not fragmented as before.
Third, let’s just review a few of the recent events from that hotbed of democratic principle, the department of Santa Cruz. Early Sunday morning the lone MAS representative on the Santa Cruz city council, Osvaldo Paredo, faced a sixth violent attack against he and his family. This time, according to a report from Radio Erbol, a group of attackers threw a live hand grenade at the window of the room where his 11-year-old daughter was asleep. Fortunately, the grenade bounced off and blew up just outside the house.
Then yesterday in Santa Cruz's Central Plaza a small mob of hunger strikers from the famous local "Youth for Democracy" physically attacked a 45-year-old ex-miner, René Vargas, after mistakenly identifying him (presumably by his skin color) as a MAS party activist (see photo above). Screaming their favored chant of "Indian shit" the youth chased the man for blocks hitting and kicking him at all the opportunities they had, until several women intervened to stop them. Bolivia's Human Rights Ombudsman, Waldo Albarracín denounced the attack, "The country watched with indignation the images on television when a group of people, four or five youth, cowardly attacked another countrymen with similar rights as them, demonstrating a racist attitude against the victim."
Is there really anyone left in Bolivia willing to say with a straight face that race is not a central factor in this conflict?

I am amazed at the lack of political savvy by both sides. In the U.S., both the wacky left and the ultra right know that at some point you have to woo the center to win.
In Bolivia, just when they are gaining some good press attention, the Crucenistas pull a racist attack. There goes the sympathy from the center.
On the other hand, people warm up to themes of social justice until Ponchos Rojos murder innocent dogs to make their point.
Is there any rationality? President Morales has called for dialog. Even if the invitation is a cynical political move, what is the downside to talking? If it really is a cynical non-starter, the Media Luna would just have more ammo for the political fight ahead.
Pray for dialog. Pray for peace.
When United States Senators are not present to vote the voices of their constituents becomes muted & unheard. Yet the vote goes on with a quorum call and the legislation then proceeds. This process is clearly out-lined in the college text “Roberts Rules Of Order”.
Who is to blame, those who showed up or those who use heated rhetoric & refuse to represent those who voted for them. The tactic is uneducated foolish, and so transparent.
Both African Americans & Native American are stated less then Human, three-fifths to be exact in many of that Country founding documents. And the condition of those populations are in direct correlation with said text.
At least the Morales Government is brave enough to confront historical wrongs. When the civil rights movement took hold in the United States such worse violence took place.
Should Bolivianos learn from our mistakes then a return to the table is the will help everyone’s agenda. Talking is better looking then fighting, & I know Bolivianos hate looking bad. So at least some hope left in vanity because human rights looks good to everybody..
Most definetly, race has been, is and will be the issue. Unless of course the mentality of superiority from the karas, pseudo whites, and other neonazis evolves and start behaving humanly. Perhaps the reaction from the "indios de mierda" will be such that the conquistadores will be left out with few choices. The current Government of Evo is left wing BUT it is very pragmatic and Evo is not Chavez. If one dismisses as best one can the 5% fom the far Left and 5% from the far right and both their rhetoric one is left with a left wing Government overlain with 400 years of slavery [ close to reality!] This article hits the nail on the head. There is a relatively bloodless Revolution going on and there is no shortage of Village idiots on both side. As long as Evo Morales and some of the opposition leaders sound like Geroge W. Bush when he proclaimed:
"Either you are with us , or you are with the terrorists", no dialogue shall be possible. Evo's talking the same discourse, either you agree with his MAS Constitution, or you're with the neo leiberal and corrupt ollygarchy. And pretty much like the GWB presidency, Evo justifies all his policies under the argument of his war against the past. It is so sad to see Bolivia tearing apart again, the lack of dialogue motivation of their leaders will cost lives, as already is happening and of course opportunities to overcome poverty.
As one very savvy Bolivian politican remarked: the proposed Constitution is worth less than a used roll of tissue paper.
I wonder how many of the assembly members who voted for it are even aware of its contents.
Now after Morales has rammed his vision of cosmic justice to us all, he asks for "dialogue" and "truce." No wonder most don't believe his intentions.
No doubt that Morales' deep racist and vengeful sentiments are due to his low self esteem product of failures during his childhood, including his tries as a trombone and a soccer player.

Wasn't the "failure of opposition representatives to attend the final sessions of the constituent assembly" due to intimidation by miners and cocaleros and indigenous groups rather than a conscious attempt to boycott the proceedings? If the sessions were held in Sucre (not in the fort outside Sucre) or in La Paz (not in the mining town of Oruro) then I would agree with Jim's point.

The foolishness of the oposition has let all this happen and there are more missinterpretations of the reality ahead, they're trying to imposse an authonomic statute (estatuto autonomico) with no backing from society, thinking tha will solve everything, that is just silly. If they had any backing from the midleclass in a single shot it will be lost.
I have read a little bit of this new constitution Evo proposses and is not as crazy as some civicos say it's very democrathic, protects private property and gives authonomy to the regions so I don't undestand why all the outcry.
I'm posting the draft constituion approved "en grande" on Nov. 24th, 2007. Perhaps we can read it together and determine whether this document is what they all claim it is?

The Idea that a country can move through this reformation process without turmoil is as interesting as pre-emptive war. A idea base of sheer speculation and ignorance.
Reporting from Bolivia, I find the overt racism horrific and the Poverty disgusting. This has all been created by the "civilized" western Business interest.
The Chaco War was fought btw Shell and Standard Oil. Now, as before both local and International media interests are currently refusing to investigate those possible connections again.

No, The United States Government is not directly supporting such violence. Yet the businesses encouraging it are based in the US, no doubt the US government knows exactly who is responsible, but it is to the interest of the Government to let this continue as long as it can without the specter of criminal prosecution within the US courts. That is the crime of the United States in this matter and its complicity.

In Bolivia, just look for the companies with the largest investments in these areas.
However, should Beni really wish to this Autonomy thing to profit from Uranium mining, The United States will absolutely take covert and overt actions to control those resources.
This week, at the New York Federal Archives, Digital Warrior Media is requesting all Federal Tax reporting information from Companies doing Business in Bolivia. This may shed some light on to the theory that Large Multi-nationals are truly behind this violence.
Those in Spain, France and Britain may wish to do the same. These are the countries that are guilty for the situation that requires such a reformation. It can only be surmised that such interest are at it again.

Lets look at some key points here
MAS LOCKED OUT THE OPPOSITION IT WAS NO BOYCOTT They purposefully gave out a wrong place and date for the final vote. In the initial vote at the military school, officialist mobs threw a ring around the complex. For days prior, these same mobs - closely linked and responsive to Evo (their words) - had issued vocal threats, including Sendero Luminoso style dog killings.
MAS HAS BEEN CONSISTENTLY BELLIGERENT, EXCLUSIONARY, AND DIVISIVE Evo, Garcia Linera, and the crew around them that appear on TV have constantly used the most incendiary and antagonistic rhetoric against the opposition. Chavez himself has joined in the fun, threatening to smash "oligarchs" in front of a statute of Che in Cuba - the leader of a real "foreign-led invasion" of Bolivian soil.
While the opposition mobs and some press have said and done pretty stupid things, it is nothing like the barrage of class hatred and racial revanchism out of officialism and their proxies in the social movements. In words and in deed they seem to be following Trostky's dictum that no matter if the people take power through the ballot box "the life or death of the bourgeoisie, will de decided not by references to the paragraphs of the constitution, but by the employments of all forms of violence"
MAS CONSTITUTION IS A DISASTER - AND EVO CAN RULE FOR LIFE
There are so many flaws, it is hard to pick out where to begin. It is inconsistent, and contradictory in many parts. But as a matter of politics, it first of all allows for Evo to be re-elected for long periods of time.
It aggregates a lot of power in the central government - including administrative functions, power of the purse. It also assigns the government "responsibilities" and "obligations" which at best are implausible. Its role in the Economy is scary. Verbatim out of the chavista reject bin - and close to the Cuban model. Property rights - a key right in both the French and Anglo-American traditions - and crucial to a modern market economy - are subordinated to subjective and totalitarian-sounding criteria. Property rights will be recognized so long as they serve the "collective interest" as well "contributing to the development of the nation"
Foreign investment - restricted. The State gets a monopoly on energy - might not even subcontract privately. It dissuades ANY future government from ever signing any sort of deal with any foreign corporation.
The document pretty much indicates that only the indigenous will get any form of real "autonomy."
It destroys the judiciary, as it exists now. Creates some really goofy new branch.
In the end, what it does it provide a lot of opportunity for mischief, inaction in the future.
I dont understand the accusation of dictatorship if it should come to pass in a constitution that a president can be elected for multiple successive terms , or for that matter - indefinatively. If there is a vote then it is democratic and, if the election is run legally and fairly, the it should reflect the will of the majority of the people - of course not everyone will be happy BUT its democracy. The UK doesnt have hoards of people shouting that its system is open to abuse by dictatorships and there is not limit the successive terms there.

El pasado 24 de noviembre, la Asamblea Constituyente en Bolivia aprobó su nueva constitución en líneas generales, la cual establecería las autonomías indígenas, la limitación de las inversiones extranjeros y la ampliación de los derechos humanos, entre otras temas. Los miembros de la oposición decidieron boicotear la votación y luego iniciaron una huelga de hambre en protesta del avance de la nueva magna carta boliviana. El próximo paso en el proceso constituyente tomará lugar antes del 14 de diciembre, cuando la Asamblea Constituyente debe aprobar la Constitución artículo por artículo. Mientras tanto, la oposición boliviana va calentando la calle y buscando desestabilizar el proceso constituyente, y como objetivo final, derrocar el gobierno del Presidente Evo Morales.
Bolivia tiene nueve departamentos (estados), de los cuales Beni, Chuquisaca (Sucre), Cochabamba, Pando, Santa Cruz y Tarija tienen gobernadores (llamados Prefactos) y/o grandes concentraciones de opositores. Hasta hoy, la sede de la Asamblea Constituyente estaba en Sucre, que oficialmente es la Capital del país y el centro del poder judicial nacional (La Paz es el centro del poder ejecutivo y legislativo). Pero durante las últimas semanas, las manifestaciones violentas de grupos opositores han escalada hasta el punto de causar cuatro muertos y al menos unas 300 personas heridas. Debido a esta situación violenta e insegura en Sucre, la Asamblea Constituyente acaba de aprobar un cambio de sede a El Chapare, zona de cocaleros y campesinas que garantiza la seguridad de las últimas sesiones necesarias para finalizar el proceso Constituyente. Sin embargo, las maniobras de la oposición siguen en marcha.
Siguiendo las líneas de Washington, la oposición boliviana – financiada y asesorada por el Departamento de Estado a través de la USAID y la National Endowment for Democracy (NED), la Fundación FAES del ex-presidente Aznar en España y varias trasnacionales – lanzó un movimiento de “resistencia civil” en desconocimiento a la nueva Constitución. El nombre, las acciones y la composición de este movimiento (clases medias y altas, mayoría blanca, empresarios, antiguos políticos) comparten muchísimos rasgos con la oposición venezolana “made en USA”. Tanto es así que no se puede negar que esta agresión contra Bolivia y el gobierno de Evo Morales forma parte de la gran estrategia imperial para destruir cualquier semilla de revolución socialista en América Latina.
Cuando el Presidente Evo Morales llamó para un dialogo con sus adversarios la semana pasada, estos reaccionaron con violencia e indiferencia, y en lugar de asistir a la reunión convocada por su Presidente, los gobernadores de las regiones de Santa Cruz, Beni, Pando y Tarija, viajaron a Washington y se reunieron con sus “jefes” en la Casa Blanca y el Departamento de Estado. También utilizaron una táctica bien usada por la oposición venezolana, y accedieron a la Organización de Estados Americanos (OEA) para denunciar lo que ellos consideran un “atropello” a la democracia boliviana a través de la aprobación de la nueva Constitución.
¿Ahora que se espera?
Los medios de comunicación, los principales empresarios nacionales e internacionales, y los partidos políticos tradicionales están atacando fuertemente al gobierno de Evo Morales. El gobierno de Estados Unidos invierte más de 120 millones de dólares al año en la oposición boliviana y en el control sobre los medios de producción del país. Esto coloca a Bolivia en una situación bastante peligrosa debida a la inmensa injerencia de Washington en sus asuntos internos, que no solamente son políticos sino también económicos, sociales y culturales.
La oposición boliviana esta utilizando a la violencia para desestabilizar al país y culpar al gobierno de Evo. Está buscando crear un clima de ingobernabilidad, tanto como ha intentando hacer la oposición al Presidente Chávez en Venezuela. Sabotaje económico, guerra mediática, violencia de calle, huelgas de hambre y desobediencia a las leyes y decisiones del gobierno son algunas de las técnicas que la oposición boliviana esta ejecutando para debilitar al mandato del Presidente Morales y entonces solicitar una intervención internacional. Evo, por su parte, ha llamado para un referéndum revocatorio en contra de su propio mandato, con la condición de que los gobernadores opositores también aceptan el referéndum revocatorio contra ellos también. Habrá que ver si esta iniciativa se manifiesta durante los próximos días.
Mientras tanto, la posibilidad de un golpe contra el gobierno de Evo Morales sigue muy vigente – ahora más que nunca. Hay que estar alerta ante esta amenaza y hacer lo posible para apoyar el pueblo boliviano y el gobierno del Presidente Evo Morales para que resistan esta agresión imperial.

Does anybody really know what that means? How can there be a "Estado Unitario" while at the same time be "Plurinacional Comunitario?" And to yapa it, this entity is supposed to be "integrador." Reminds me of Kerry's "I voted for the bill before I voted against it." And that's just for starters.
As much as Morales elevates his victimhood railing against colonialism, his document extols it: the Spaniards colonists left a legacy of heavy bureaucracy and centralism, which meant that millions and billions of useless words have been written instead of a few thousand quality ones. This unintelligible document is a perfect representation of Spanish colonial legacy.
I can't wait for this document to be printed in rolls of tissue paper by an entrepreneurial soul.

Bolivia is one nation, undivisible with liberty and justice for all.
Or why even state official languages, symbols, or economic ideology. It would be far better if none of those things were mentioned to begin with.

Interesting, as a former stock broker, There is an understanding that in this global economy, companies are owned by share-holders and no company if wholly owned by one person and/or country.
